BeyondTrucks, Inc. (“BeyondTrucks”) offers fleet owners and trucking companies (as applicable, “you” or “your”) access to software, money movement, and financial services. This Privacy Notice describes how BeyondTrucks (“we” or “us” or “our”) collects, uses, and discloses information when you use our websites, mobile applications, and other online products and services (collectively, the “Services”) or when you otherwise interact with us.


This Privacy Notice does not apply to the extent we process personal information in the role of a processor or service provider on behalf of our customers, including where we offer to our customers various software products and services through which our customers (or their affiliates) collect, use, share or process personal information. For detailed privacy information related to a BeyondTrucks customer or a customer affiliate who uses the BeyondTrucks Services as the controller, please contact our customer directly. We are not responsible for the privacy or data security practices of our customers, which may differ from those explained in this Privacy Notice.


We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the Effective Date at the top of this Privacy Notice, and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification on our mobile app or via email). We encourage you to review this Privacy Notice whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.


I. Collection of Information


Information You Provide to Us

We collect information you provide directly to us. For example, we collect information when you fill out a form, request to obtain information or log in to your BeyondTrucks account, request customer support, or otherwise communicate with us. This information may include name, company name, email address, phone number, address, financial information, video and call recordings, insurance information, service ratings and reviews, and any other information you choose to provide.


Information We Collect When You Use the Services


Fleet Owners: If you are a fleet owner, we collect information about your lane preference, acceptance, and fulfillment of any jobs or requests, including financial, vehicle, and driver information.


Drivers: If you are a driver transporting cargo, we may collect information on your travel to fulfill a Shipment request. We also collect information about your location and about documents you upload, as described below.


Partners: If you are a broker, intermediary, or other third party partnering with BeyondTrucks (“Partner”), we may collect information on any Shipment request, origin and destination information, customer information, description of the cargo being transported, rate, email addresses, and any other information you choose to provide.


Location Information

Providing Services to our users requires the collection of precise location information. When you download or use our mobile applications, we may ask for permission to access your precise location. If you grant our mobile applications permission to access your location through the permission system used by your mobile operating system, we will collect the precise location of your mobile device. We use this information to track Shipments, understand your typical driving patterns, and to potentially offer Drivers jobs that are more likely to be relevant to them. You may deny or revoke your permission at any time but doing so may affect your ability to utilize all features of our Services or Incentive Programs, including your eligibility for instant pay or your ability to recover incidental fees.

We may also derive your approximate location from your IP address or phone number. We may also receive information about your location from third parties, such as the Shippers involved in fulfilling any Shipment request, or from sensors installed on trailers owned, leased, or controlled by BeyondTrucks.


Photographs and Documents

Our Services may ask you to photograph and upload to the Services certain documents related to the fulfillment of a Shipment request, such as certificates of insurance and other legal documents, bills of lading, and proofs of delivery. You may also be able to upload pictures of cargo that you carry and/or trailers owned, leased, or controlled by BeyondTrucks. To do this, our mobile applications will request access to the camera on your mobile device via the permission system used by your mobile operating system. You may deny the requested access but doing so may affect your ability to utilize all features of our Services.


Information We Collect Automatically When You Use the Services

When you access or use our Services, we automatically collect information about you, including:

Log Information: We collect log information about your use of the Services, including the type of browser or mobile app version you use, access times, pages viewed, your IP address, and the page you visited before and after navigating to our Services.


Device Information:We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, mobile device and mobile app identifiers, and mobile network information.


Information Collected by Cookies and Other Tracking Technologies:  We use various technologies to collect information, including cookies and web beacons. Cookies are data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons are electronic images that may be used in our Services or emails and help deliver cookies, count visits, and understand usage and campaign effectiveness. You may instruct your browser to block cookies but doing so may limit your ability to utilize all features of our Services. Information We Collect From Other Sources

We may also obtain information from other sources and combine that with information we collect from you directly. These third parties include, but are not limited to, Partners, verification services (for instance, to confirm your insurance or regulatory compliance status), credit agencies and bureaus, and publicly available sources.


II. Use of Information

We use the information we collect to provide and improve our Services, including to connect Shippers with Drivers, match Drivers with Shipment requests, facilitate transportation of cargo, process payments, and confirm delivery. We use your phone number to call you and send you SMS messages. We may also use information about you for other purposes, including to:

  • Send you technical notices, updates, security alerts and support, and administrative messages;

  • Respond to your comments, questions, and requests and provide customer service;

  • Communicate with you about products, services, offers, opportunities, promotions, rewards, and events offered by BeyondTrucks and others, and provide news and information we think will be of interest to you;

  • Monitor and analyze trends, usage, and activities in connection with our Services;

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of BeyondTrucks and others;

  • Personalize and improve Services and provide advertisements, content, or features that match user profiles or interests;

  • Link or combine with information we get from others and create data profiles to personalize our Services to better understand your needs and provide you with better service; and

  • Carry out any other purpose described to you at the time the information was collected.


III. Sharing of Information

We share information we collect about you, as described in this Privacy Notice or as at the time of collection or sharing, including sharing with other users of our Services and various third-parties as described below.


Sharing with Other Users of our Services

Depending on how you use our Services, we may share information about you with other users of the Services. For example, if you are a driver, we share your name, vehicle information, precise or approximate location, and certain contact information (including phone number) with your Carrier or Shippers involved in the Shipment request you helped to fulfill. If you are a Shipper, Broker, Carrier or Partner, your name or company name, your instructions, address, and contact information will be shared with drivers who will transport cargo. Certain documents and information that you submit to our Services in connection with a Shipment request, such as feedback, Shipment, and payment history with BeyondTrucks, may be shared with other users. If you submit driver ratings and reviews, this information may be shared with other users of our Services.


Sharing with Service Providers, Affiliates, and Other Third Parties

We may also share information about you with other third parties, such as:

  • With vendors, consultants, Partners, and other service providers who need access to such information to carry out work on our or your behalf;

  • If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property, and safety of BeyondTrucks or others, with law enforcement or other entities and individuals;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company;

  • Between and among BeyondTrucks and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership;

  • With third-party marketing and advertising organizations, through website cookies, in order to market our Services and our websites and other websites that you may visit;

  • With your consent or at your direction;

  • We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.


IV. Advertising and Analytics Services

We may allow others to provide advertising and analytics services on our behalf across the Internet and in applications. These services may use cookies, web beacons, device identifiers, and other technologies to collect information related to your use of the Service, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information.


Google Analytics. We may use Google Analytics. We use the information we get from Google Analytics only to improve this site. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Please refer to Google’s Privacy Policy for more information. You may also choose to download the Google Analytics opt-out browser add-on .

You may wish to restrict the use of cookies. Please be aware that some of the features of our website may not function correctly if you disable cookies.

Most modern browsers allow you to change your cookie settings. You can usually find these settings in the options or preferences menu of your browser. To understand these settings, the following links for commonly used browsers may be helpful:

Personalized Advertising. We may also use targeted advertising cookies to deliver tailored advertising on our Sites and other websites that you may visit. You can learn more about how to control advertising cookies by visiting the Network Advertising Initiative’s Consumer Opt-Out link, the DAA’s Consumer Opt-Out link for browsers, or the DAA’s opt-out link for mobile devices. Please note that electing to opt-out will not stop advertising from appearing in your browser or applications and may make the ads you see less relevant to your interests.


V. “Do Not Track” Signals

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We do not recognize or respond to browser-initiated DNT signals, as the Internet industry is currently still working toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT.

You may have certain rights relating to your personal information, subject to local data protection laws. Please contact us using the contact details provided in the “Contact Us” section below if you would like to exercise your privacy rights.


Marketing Opt-Out: We may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe instructions provided in any email we send, or you can contact us using the contact details provided in the “Contact Information” section below. You will still continue to receive service-related messages concerning products, services, or subscriptions you have purchased (unless we have indicated otherwise).


Additional Disclosures for Certain U.S. State Residents

We have listed the privacy rights for certain U.S. state jurisdictions below, but we understand you may have additional rights in your jurisdiction. You may contact us directly at any time about exercising your data protection rights. We will consider your request in accordance with applicable laws.

Certain state laws require that we detail the categories of personal information that we disclose for certain “business purposes,” such as to service providers that assist us with securing our services or marketing our products.

We disclose the following categories of personal information for our business purposes:

  • • Identifiers;

  • Personal information under California Civil Code section 1798.80;

  • Commercial information;

  • Internet activity information;

  • Electronic, visual and similar information;

  • Professional and employment-related information; and

  • Inferences drawn from any of the above information categories.

Sensitive Categories of Personal Data:

  • State identifiers, such as driver’s license information;

  • Financial data; and

  • Precise geolocation data.

Several jurisdictions grant state residents certain rights, including the right to access specific types of personal information, the right to learn how we process personal information, the right to correct inaccurate personal information, the right to know whether and how we disclose or sell personal information, the right to opt out of any sale of personal information, the right to request deletion of personal information in certain circumstances, the right to limit the use of your sensitive personal information, and the right not to be denied goods or services for exercising these rights.


Do Not Sell or Share My Personal Information. In the preceding twelve months we have not sold personal information. We do not sell personal information, but we recognize that some state privacy laws define “personal information” in such a way that some sharing of personal information necessary to provide you with personalized ads may be considered a “sale,” even if no money is exchanged. Limit the Use of My Sensitive Personal Information. We do not use or disclose sensitive personal information for any purpose other than providing our goods and services to you, or as otherwise permitted under applicable law.


Third Party Marketing. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the third parties’ direct marketing purposes.

To submit a request, please contact us using the information provided below in Section VI “Contact Us”. We may need to verify your identity and place of residence before completing your rights request.


Your Rights Related to Customer Data

As described above, we may also process personal information submitted by or for a customer to our software products and services. To this end, if not stated otherwise in this Privacy Notice or in a separate disclosure, we process such personal information as a processor on behalf of our customer (and its affiliates) who is the controller of the personal information. We are not responsible for and have no control over the privacy and data security practices of our customers, which may differ from those explained in this Privacy Notice. If your data has been submitted to us by or on behalf of a BeyondTrucks customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with them directly. Because we may only access a customer’s data upon their instructions, if you wish to make your request directly to us, please provide us the name of the BeyondTrucks customer who submitted your data to us. We will refer your request to that customer and will support them as needed in responding to your request within a reasonable timeframe.


VII. International Transfers of Data

Any data that you provide to us may be accessed, shared or processed by our offices, located in the United States, and service providers located in the United States, if such data transfer is necessary for the specific purpose for which you submitted your data (such as the provision of goods or services under a written contract). This may entail a transfer of your personal information across international borders. The data protections standards may differ and be lower than the standards enforced in your jurisdiction.


VIII. Children’s Privacy

The Services are not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information, please contact us using the contact details provided in the “Contact Us” section below. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.


IX. Change of Control

Personal information may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other change in control. If we sell, merge or transfer any part of the business, part of the sale may include your personal information.


X. Security and Data Retention

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. For example, when possible, we use encryption to transfer and store data. We further limit access to this data using access controls and confidentiality commitments.

However, no website, application, or transmission can guarantee security. Thus, while we have established and maintain what we believe to be reasonable procedures to protect the confidentiality, security, and integrity of personal information obtained through the Sites, we cannot ensure or warrant the security of any information you transmit to us.

We retain information from or about you for so long as necessary to fulfill the purposes outlined in this Privacy Notice. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrolment with our products or services, the impact on the services we provide to you if we delete some information from or about you, mandatory retention periods provided by law and the statute of limitations.
